Terms of Service

Please read the following Terms of Service carefully, as all members are required to agree to them when signing up for an account. They may be subject to change at any time. Any changes will take effect immediately, and all members will be notified by email that changes to the Terms of Service have been made.

Provision of Service
The service is provided on an "as is" basis. Mystical Clicks will not be liable for any problems such as loss of data or profits associated with using the service, and may withdraw the service at any time. Your use of this service is at your own risk.

Member Accounts

1	Only one account is permitted per individual or computer. If you are found to have more than one account, all of your accounts may be terminated, with the loss of any credits and referrals.
2	You are required to provide a valid email address when signing up for an account, and that email address must not point to an automated response service. It is your responsibility to ensure your email address is updated if necessary. You are required to use a real name for government compliance regarding tax, money laundering, and homeland securty laws.
3	As an account holder, you agree to accept email from Mystical Clicks providing details of updates to the site or service, contests or special offers that may run from time to time, and any other information that Mystical Clicks admin considers may be of interest to members.
4	Should you wish to cancel your account, you may do so at any time through the link in the members area. Cancellation will automatically result in the loss of all credits and referrals on the account. If you are an upgraded member at the time of cancellation, it is your responsibility to cancel your subscription payment. If any subscription payments are made after cancellation of your account, Mystical Clicks cannot guarantee to refund them.
5	If you hold an upgraded account, and your monthly subscription payment is not made, or is made late, your account will revert to free status until payment is made.
6	You are not permitted to enroll other members. If you wish to refer new members, you may do so by directing them to your referral link, and inviting them to enroll themselves. If you are found to have enrolled another member for the purpose of gaining credits or money, your account, and any accounts you have enrolled, may be terminated, with the loss of any credits and referrals.
7	You are not permitted to offer financial incentives to gain referrals or to pay for referrals. This includes the use of services to purchase signups. If you are found to have offered a financial incentive for the purpose of gaining referrals, your account may be terminated, with the loss of any credits and referrals.

Eligibility, Accounts, Password, and Security

Mystical Clicks is a membership-based, online social community exclusively for online marketers 18 years old and over. For Members under the age of 18, Mystical Clicks requires, prior to giving Members access to the entire Site, the parent/legal guardian of each prospective Member to open an account with Mystical Clicks and complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. As part of this registration process, the parent/legal guardian of prospective Members will be requested to provide certain personal information and his/her consent to allow Mystical Clicks and/or its agent to conduct a background check to screen against registered sex offenders where applicable. The parent/legal guardian will be asked to provide their full name, address, date of birth, and zip code. You and your parent/legal guardian acknowledge that Mystical Clicks conducts such screening as its best, commercially reasonable effort to make the Site and the Mystical Clicks community a safe environment for Members, but Mystical Clicks  are not making any guarantee that the Site will be free from sexual predators or other criminal or offensive behavior. By opening up an account and registering your child/children as Member(s), you represent and warrant that you are not required to register as a sex offender with any government entity, and you are providing TrafficJam Pro with your parental consent. You also hereby agree to this Terms of Use on behalf of your child/children and yourself, and give your child/children permission to access the entire Site, including the message boards and chat rooms (among others). Mystical Clicks reserve the right to conduct a criminal background check, at any time, using publicly available records, to confirm your compliance with this subsection. Mystical Clicks reserves the right to refuse to register a prospective Member and/or delete the profile of a current Member if he/she does not have a parent/legal guardian whose identity can be verified through this process and/or if the parent/legal guardian information matches that in the registered sex offender database.

Each Member and his/her parents/legal guardians may also be asked to choose a password and a user name. Your account is for your personal use only. You may not authorize others to use your account, and you may not assign or otherwise transfer your account to any other person or entity. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Mystical Clicks immediately of any unauthorized use of your account or any other breach of security. Mystical Clicks will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Mystical Clicks or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder.
 

Websites in Rotation

1	At Mystical Clicks, our aim is to provide you with the best advertising service we can, and with that aim in mind, we try not to restrict too much the content of sites that can be shown in the rotator. If your site content is legal and family friendly, it will probably be approved. To clarify, here is a list of site content we will NOT approve: * Pornography and adult content * Warez * Hate sites * Sites where the main language is not english * Any content that our staff considers to be offensive Other sites that will not be approved are: * Sites that have more than one pop-up * Sites that have a popup that does not automatically close on exit * Sites promoting HYIP, paid-to-surf, or other ponzi programs * Gifting sites * Banner farms * Sites that break frames * Sites that freeze the surf bar * Sites that contain viruses or other harmful content * Sites that contain script downloads If your site disrupts the surfing process in any way, it will not be approved.
2	Mystical Clicks will make every attempt to ensure that all sites in rotation conform to the conditions stated in this ToS. However, Mystical Clicks and its staff will not be held liable for any site appearing in the rotator that does not conform. If you find such a site while surfing, please report it using the link in the surf bar.
3	Mystical Clicks will not be liable for any income claims made by sites that are placed in rotation.

Use of the Surf Bar
Mystical Clicks is a manual traffic exchange designed with user participation in mind. Auto-click, auto-refresh, or any other programs that are designed to automate the surfing process are not permitted. If you are found to be using such a program, your account will be terminated with the loss of all credits and referrals.

Promoting Mystical Clicks
You are permitted to use any legal and ethical means to promote the Mystical Clicks service, including, but not limited to, placing your affiliate site or links to it on other traffic exchange services, forums and other websites, where permitted. You may not use unsolicited commercial email or SPAM to promote your affiliate site. If you are found to have done this, your account will be terminated with the loss of all credits and referrals.

Transfer of Credits
Credits may be transferred between members and their referrals using the transfer credits option in the members area. Credits may not be sold, or given in exchange for any other product or service.

Payments
Commission payments are made on request when the account balance exceeds or is equal to $20. Payments are made by PayPal or AlertPay, and will be processed within 5 days of the request being received. We will make every effort to pay commissions on time to the payment processor you request. However, we cannot be held responsible for delays caused by processor site maintenance or downtime, errors in the information you have provided, or any other event that is beyond our control.

Refunds
All sales of upgraded accounts and credits are final, and no refunds will be given.

No Unlawful or Prohibited Use

As a condition of your use of Mystical Clicks, you agree that you will not use the Site for any purpose that is unlawful or prohibited by these Terms of Use. You may not use this Site in any manner that could damage, disable, overburden, or impair any Mystical Clicks server, or the network(s) connected to any Mystical Clicks server, or interfere with any other party’s use and enjoyment of the Site. You may not attempt to gain unauthorized access to the Site, other accounts, computer systems or networks connected to any TrafficJam Pro’s server or the Site, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Site.

Contests, Mystical Clicks Rewards, Prizes and Other Activities

Mystical Clicks provides rules of participation ("Rules of Participation") for certain activities on this Site including, without limitation, contests and rewards by Mystical Clicks, and/or in conjunction with third parties. This Agreement is incorporated by reference to the specific Rules of Participation, which appear in connection with information about a particular activity. To the extent that any conflict exists between this Agreement and specific Rules of Participation, the Rules of Participation for the specific activity in which you choose to participate shall govern.
Assignment

These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Mystical Clicks without restriction.

Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE SITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, Mystical Clicks, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF. Limitation of Liability

IN NO EVENT SHALL Mystical Clicks, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (Mystical Clicks) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE Mystical Clicks SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY ACKNOWLEDGE THAT Mystical Clicks SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

Mystical Clicks AND ITS AGENTS USE VARIOUS WAYS OF VERIFYING INFORMATION AND SCREENING FOR REGISTERED SEX OFFENDERS, HOWEVER, NONE OF THOSE WAYS ARE PERFECT. BY USING THIS SITE, YOU AGREE THAT Mystical Clicks AND ITS AGENTS WILL HAVE NO LIABILITY TO YOU ARISING FROM ANY INCORRECTLY VERIFIED INFORMATION, AND FALSE NEGATIVE OR FALSE POSITIVE RESULTS FROM THE SCREENING FOR REGISTERED SEX OFFENDERS.

The Site is controlled and offered by Mystical Clicks from its facilities in the United States of America. Mystical Clicks makes no representations that the Site is appropriate or available for use in other locations. Those who access or use the Site from other jurisdictions do so at their own volition and are responsible for compliance with local law.

Indemnity

You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Site in violation of these Terms of Use and/or your breach of these Terms of Use, any breach of your representations and warranties set forth in these Terms of Use, or your violation of any law or the rights of a third party.

DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITIES, INDEMNIFICATION

Mystical Clicks does not warrant that the website and service will be error free or uninterrupted. The website and service is provided on an "as is" basis without warranties of any kind, either expressed or implied.

Mystical Clicks will not be responsible for any losses, damages or costs that you and/or your business may suffer when using the website or service. You agree to indemnify and hold harmless Mystical Clicks from any claims resulting from your use of the website or service.

You expressly agree that use of the website or service is at your sole risk. Neither Mystical Clicks nor its service providers, agents, licensors or employees shall have any liability for any damages suffered by you or any other party as a results of the use or misuse of the service.
